2. Purpose
The present document constitutes the General Terms of Use of the Site.
The purpose of this document is to define the terms and conditions under which you may access and consult the Site and its elements.
You acknowledge that consultation of the Site and its elements is subject to compliance with these General Terms of Use.
3. Acceptance / Modification of the General Terms of Use
NAVYA provides the Site subject to your agreement to abide by these General Terms of Use.
By connecting to the Site, you unconditionally and unreservedly accept the General Terms of Use in their latest version in full.
NAVYA may modify and update these General Terms of Use and the Site at any time without notice. You are presumed to have accepted these General Terms of Use simply by consulting the Site. Consultation of the Site automatically implies acceptance of the latest version of these General Terms of Use.
4. Intellectual Property
You are informed that many elements of the Site are protected by French legislation on intellectual property (copyright, designs and/or trademarks). These include NAVYA's trademarks and logos and the design of NAVYA's vehicles. The elements thus protected are the property of NAVYA or of third parties having authorized NAVYA to use them.
Consequently, any reproduction or representation, use, adaptation, modification, incorporation, translation, marketing, by any process and on any support whatsoever, in part or in full, of any of the elements of the Site is forbidden without the prior written authorization of NAVYA, apart from the exceptions set out in article L.122-5 of the French Intellectual Property Code, under penalty of constituting an infringement of copyright and/or designs, which may be punished by three (3) years imprisonment and a fine of three hundred thousand euros (€300,000), and/or an infringement of trademark, which may be punished by four (4) years imprisonment and a fine of four hundred thousand euros (€400,000).
5. Personal data
You are not required to disclose your identity or any other personal data in order to consult the Site.
By filling in the forms available on the Site and by ticking the boxes provided for this purpose, you expressly give your consent for your personal data, that you decide to communicate, to be processed by NAVYA and NEWCAP for the sole purpose of allowing you to receive:

with respect to the form, you have previously filled in, in that respect (the "Purposes").

- Not to process your personal data for any purpose other than the Purposes or in contradiction with the Purposes;
- Not to publish, disclose or transmit any information about you without your prior consent;
- To retain your personal data for no longer than is necessary for the Purposes;
- To implement appropriate technical and organizational measures to protect your personal data against accidental or unlawful destruction, accidental loss, alteration, disclosure, or unauthorized access.
You acknowledge that NAVYA and NEWCAP may be required to disclose any information about you, apart from the case where you have given your express consent:
- Where the transfer is occasional and necessary in the context of a contract or legal action, whether judicial, administrative or extrajudicial, including proceedings before regulatory authorities;
- When required for important public interest grounds established by European Union law or French law.
In accordance with the provisions of the Personal Data Legislation, you have the right to access, rectify, delete, limit the processing of, oppose and port your personal data.

6. Access to the elements of the Site
The elements of the Site are accessible via the Internet network.
All costs related to accessing the elements of the Site, whether hardware, software, or Internet access, are at your expense.
You are solely responsible for the proper functioning of your computer equipment and your access to the Internet.
You declare that you accept the characteristics and limits of the Internet and acknowledge that you are aware of the nature of the Internet and, in particular, its technical performance, the response times for consulting, querying or transferring information, the risks of interruption and, more generally, the risks inherent in any connection and transmission on the Internet. NAVYA makes every reasonable effort to ensure quality access to the elements of the Site, but NAVYA is under no obligation to achieve this.
7. Information about the elements of the Site
The elements appearing on the pages of the Site are based on the technical characteristics in effect at the time the various pages of the Site were put online or updated.
The elements of the Site are general information and have no contractual value.
8. NAVYA's responsibility
NAVYA shall not be held liable for any reason whatsoever, including but not limited to, any modification, suspension, or interruption of the Site and/or access to its elements.
NAVYA cannot be held liable for the reliability of data transmission, access times or any restricted access to the Internet or networks connected to it. You are responsible for any damages that NAVYA may suffer as a result of your use of the Site and its elements that does not comply with applicable laws and/or regulations and/or provisions.

The Site includes a cookie system.

13. Applicable law / Jurisdiction
The Site and these General Terms of Use are governed by French law, excluding the rules of conflict of laws and jurisdiction.
Any dispute that may arise concerning the interpretation and/or the execution of these General Terms of Use shall be subject to an attempt at amicable settlement.
In absence of such amicable settlement, the courts of Lyon shall be the sole competent to decide any disputes arising hereunder.
